SIXTH: The time limit for service of a Notice of Claim upon the public corporation is: no later thanJuly 15, 2013
SEVENTH: Any statutory provisions uniquely pertaining to the public corporation and the commencement of an action or proceeding against it are as follows: f. DESIGNATION OF THE SECRETARY OF STATE AS AGENT FOR SERVICE OF NOTICE OF CLAIMS WHEREAS, the New York State Legislature recently enacted the Uniform Notice of Claim Act ("UNCA"), codified at General Municipal Law §53, which requires each public corporation entitled to be served with a notice of claim pursuant to General Municipal Law §50-e to file a certificate with the Secretary of State, by no later than July 15, 2013, designating the Secretary as agent for alternate service of notices of claim; and WHEREAS, pursuant to Education Law §3813(2), for tort claims where the alleged tort was committed by a teacher, member or employee acting in the discharge of his/her duties within the scope of his/her employment and/or under the direction of the board of education, a notice of claim must be served in compliance with section fifty-e of the general municipal law; and WHEREAS, the UNCA further requires each affected public corporation to designate an officer or agent of the public corporation to receive transmittals of notices of claim served on the Secretary of State; NOW, THEREFORE, BE IT RESOLVED that the Board of Education of the Mahopac Central School District hereby approves the designation of the New York Secretary of State as the District's agent for service of notices of claim alleging tort claims where the alleged tort was committed by a teacher, member or employee acting in the discharge of his/her duties within the scope of his/her employment and/or under the direction of the board of education; and BE IT FURTHER RESOLVED that the Board of Education of the Mahopac Central School District hereby designates the District Clerk as the officer who shall accept transmittals of notices of claim served on the Secretary of State pursuant to the UNCA; and BE IT FURTHER RESOLVED that the Board of Education of the Mahopac Central School District hereby authorizes or his/her designee to file a certificate with the New York Department of State pursuant to the requirements of the UNCA and in accordance witl1 the designations established by this Resolution.

Note: If the public corporation does not have a Vendor ID issued by the Office of the State Comptroller the Department of State will contact the public corporation regarding issuance of a Vendor ID when fees for service of Notices of Claim are available for distribution. The public corporation will not receive distributions of its share of fees for service of Notices of Claim until it has been assigned a Vendor ID by the Office of the State Comptroller.
