| SEVENTH: Any statutory provisions uniquely pertaining to the public corporation and the commencement of an action or proceeding against it are as follows: RESOLUTION AUTHORIZING NOTICES OF CLAIM TO BE SERVED UPON THE NEW YORK SECRETARY OF STATE AND AUTHORIZING THE VILLAGE CLERK TO COMPLETE A CERTIFICATE OF DESIGNATION The Village Board of the Incorporated Village of Port Jefferson, duly convened in Regular Session, does hereby resolve as follows: WHEREAS, on December 17, 2012, Governor Cuomo signed the Uniform Notice of Claim Act into law which enacted General Municipal Law § 53. The Act, which became effective on June 15, 2013, amended New York’s General Municipal Law to allow notices of claim against cities and villages to be served on the New York Secretary of State as agent for New York’s public corporations. Pursuant to the Act, the New York Department of State will forward any notice of claim served on it to the individual the city or village designates to receive the notices of claim; and WHEREAS, it is more efficient to have notices of claim served upon the New York Secretary of State instead of Village officials; NOW THEREFORE, be it RESOLVED by the Board of Trustees: THAT, the New York Secretary of State is hereby appointed as agent for the service of notices of claim on the Village of Port Jefferson; THAT, the Village Clerk is hereby designated and appointed as the individual to whom the New York Secretary of State must forward notices of claim; THAT, the Mayor and the Village Clerk are duly authorized to take all necessary steps in order to effectuate this Resolution. |
