| SIXTH: The time limit for service of a Notice of Claim upon the public corporation is: Ninety (90) Days |
| SEVENTH: Any statutory provisions uniquely pertaining to the public corporation and the commencement of an action or proceeding against it are as follows: WHEREAS, on December 17, 2012, Governor Cuomo signed the Uniform Notice of Claim Act (“Act”), which Act amended the New York State General Municipal Law to allow Notices of Claim against municipal corporations to be served on the New York State Secretary of State, as agent for those corporations; and WHEREAS, the Act added a new Section 53 to the General Municipal Law, requiring municipal corporations to file with the New York State Department of State a certificate: (a) designating the Secretary of State as the local government’s agent for service of Notices of Claim; (b) providing the name and address of an officer, person, or designee, nominee or other agent-in-fact to which the Secretary of State will forward any Notices of Claim; and (c) providing the applicable time limit for the filing of a Notice of Claim; and WHEREAS, the Act had an effective date of June 15, 2013; and WHEREAS, municipal corporations are required to file said certificate no later than thirty (30) days after the date upon which the Act became effective. RESOLVED, that the Board of Trustees of the Village of Voorheesville hereby authorizes the Clerk/Treasurer to prepare and file the certificate required by General Municipal Law Section 53, and to execute any necessary documents or form associated therewith. |
